Normative Effectiveness and Organizational Acculturation: An Interdisciplinary Approach to Compliance in Low-Adherence Contexts

This study investigates the limits of formal normativity within compliance programs, based on the distinction between the validity and effectiveness of norms and the growing centrality of principles in contemporary law. It starts from the premise that the mere existence of rules, even when technically adequate, does not guarantee their observance, especially in contexts characterized by low normative adherence. In this scenario, the article proposes the notion of “acculturation actions” as a theoretical construct intended to systematize the mechanisms through which normative standards are internalized within organizational environments. The research develops a typology of such actions, highlighting their heterogeneous legal nature and their mediating role between norm and behavior. The article then examines compliance as an interdisciplinary phenomenon, emphasizing the influence of social, psychological, and institutional factors on the shaping of conduct. From this ramework, it analyzes contexts of low normative adherence, in which deviance emerges as an adaptive response and spreads through social dynamics, contributing to the formation of a parallel normativity. Within this context, the concept of “escape valves” is introduced as informal mechanisms of adaptation between norm and practice, whose ambivalent function combines systemic stabilization and normative erosion. Finally, the article proposes a spiral model of acculturation, understood as a pedagogicalinstitutional process of continuous learning, in which norms, behaviors, and organizational responses interact cumulatively. It concludes that the effectiveness of compliance depends less on normative production and more on the capacity to build coherent institutional environments in which normativity is progressively internalized by agents.
