Comparaison entre les Directives de la Communauté européenne concernant la passation des marchés et la Loi type de la CNUDCI

Abstract

On trouvera ci-après un tableau comparatif des Directives de la Communauté européenne concernant la passation des marchés et de la Loi type de la CNUDCI sur le même sujet. La plupart des pays d'Europe centrale et orientale se sont fondés sur la Loi type pour élaborer, au début des années 90, leurs lois sur la passation des marchés publics. A présent que beaucoup de pays de cette région sont candidats à l'adhésion à l'Union européenne, il leur faut adapter leurs lois aux directives communautaires.1 Le tableau met en lumière les principales différences et similitudes existant entre les directives européennes et la Loi type à propos d'aspects essentiels. Il n'a pas pour objet d'offrir une comparaison exhaustive de toutes leurs dispositions. Pour une analyse plus détaillée et juridiquement plus précise de celles-ci, les personnes intéressées sont invitées à se reporter aux textes eux-mêmes ainsi qu'aux commentaires juridiques de la législation communautaire et de la Loi type de la CNUDCI.
