Partage d’informations et politique de la concurrence

Abstract

Les règles de la concurrence régissant le partage d’informations doivent concilier deux risques principaux : des règles permissives peuvent faciliter une collusion tacite ou un comportement explicite d’entente, tandis que des cadres trop restrictifs peuvent freiner une collaboration légitime et créer des inefficacités sur le marché. Ce document examine comment les différentes formes d’échange d’informations affectent les incitations des entreprises et les résultats du marché, en s’appuyant sur la littérature économique récente. Il examine également la manière dont les autorités de la concurrence des juridictions de pays Membres de l’OCDE abordent la question dans la pratique, notamment par les moyens d’application, la jurisprudence et les orientations. Cette note vise à donner des précisions sur les principaux facteurs qui déterminent le risque concurrentiel et la manière dont ces facteurs sont pris en compte dans l’évaluation et la mise en œuvre actuelles.
