Precarización y fraude laboral en la industria pesquera marplatense. La (de)construcción de una "ficción legal" (1990-2010)

Abstract

En este artículo observo los mecanismos adoptados para ocultar la relación de dependencia en la industria pesquera procesadora a partir de la década de 1990. El estudio se desprende de un corpus de sentencias judiciales de los tribunales laborales locales y de la SCJBA, a través de las cuales se evidencian las prácticas de tercerización e informalidad adoptadas por las empresas del sector. A lo largo del período, se manifiesta una creciente dificultad para demostrar el carácter laboral del vínculo, lo que redunda en un aumento de las homologaciones -acuerdos- en detrimento de las sentencias. De este modo, el fraude laboral se perpetúa, en tanto la homologación implica la renuncia al reclamo por parte del trabajador. No obstante, el tratamiento judicial no constituye un todo homogéneo, y es posible hallar fallos que trascienden el conflicto particular, colaborando así a la penalización de estas prácticas.
