Nouveautés apportées par la Convention Internationale des Droits de l'Enfant. Enjeux et espoirs

Abstract

Au-delà des difficultés posées par la mise en conformité du droit national aux dispositions de la Convention Internationale des Droits de l’Enfant, il paraît nécessaire de s’interroger sur les moyens effectivement mis en œuvre pour assurer réellement des conditions qui permettent aux enfants de jouir des droits reconnus par le Traité. En effet, la Convention comporte des références à des conditions qui pourraient être qualifiées de conditions « idéales ». Or, afin de pouvoir transposer cet « idéal » dans la réalité, les conditions de vie, ainsi que le milieu social et familial de l’enfant doivent être pris en compte. Dès lors, une action combinée entre, d’une part, les politiques sociales et familiales et, d’autre part, le droit, pourrait-elle constituer une solution possible ?
