Justiça do Trabalho e Produtividade no Brasil: checando hipóteses dos anos 1990 e 2000

Abstract

Este texto apresenta um conjunto de evidências empíricas para “testar” algumas hipóteses a respeito dos impactos da Justiça do Trabalho sobre a produtividade laboral. Hipóteses de que a atuação da Justiça do Trabalho incentivaria, ainda que de maneira involuntária, comportamentos oportunistas e imediatistas por parte de empregadores e trabalhadores. Esses comportamentos, por sua vez, resultariam em descumprimento dos contratos de trabalho (algo concernente ao problema da informalidade), em rompimento precoce desses contratos (algo referente ao problema da rotatividade), bem como em perdas para a produtividade laboral (o foco central da análise aqui desenvolvida). As evidências empíricas apresentadas neste texto mostram que essas hipóteses, que versam sobre comportamentos oportunistas e imediatistas, parecem se confirmar principalmente no que se refere ao comportamento dos empregadores. Afinal, do ponto de vista temporal e monetário, eles parecem ter algo a ganhar, seja com a postergação dos pagamentos dos créditos, seja com a mitigação (deságio) destes pagamentos. Por sua vez, no que concerne aos trabalhadores, eles parecem ter algo a perder com ambos os fenômenos (postergação e mitigação no pagamento de seus créditos). This text presents a set of empirical evidence to “test” some hypotheses about the impacts of Labor Justice on labor productivity. Hypotheses that this justice would encourage opportunistic and immediatist behaviors of employers and workers. And these behaviors would result in noncompliance with labor contracts (something concerning to the problem of informality), early termination of these contracts (something related to the problem of turnover), as well as losses for labor productivity (the central focus of analysis of this text). The empirical evidence presented here shows that these hypotheses, which concern to opportunistic and immediatist behaviors, seem to be confirmed mainly by the behavior of employers. After all, from temporal and monetary perspectives, they seem to have something to gain, either with the postponement of credit payments or with the mitigation (or discount) of these payments. In turn, by the workers’ side, they seem to have something to lose with both phenomena (with the postponement and the mitigation of credit payments).
