Regulação e Emprego: o caso da Convenção no 158 da Organização Internacional do Trabalho

Abstract

Apesar de ser um fato pouco conhecido, a Convenção no 158 da Organização Internacional do Trabalho (OIT), que proíbe a demissão de um funcionário sem justa causa, vigorou no Brasil entre 10 de abril e 20 de novembro de 1996, propiciando, assim, uma excelente oportunidade para se verificar o efeito da regulação sobre o mercado de trabalho. Com o uso de dados da Pesquisa Mensal de Emprego (PME) e utilizando um modelo Probit, foi possível demonstrar que, durante o período de vigência dessa convenção, tanto a probabilidade de o indivíduo obter emprego quanto a de se inserir no mercado formal de trabalho sofreram efeito negativo. Although it is a little known fact the Convention no 158 of International Labor Organization (ILO) which prohibits the dismissal of an employee without cause ruled in Brazil from 10 April to 20 November 1996 and thereby providing an excellent opportunity to evaluate the effect of regulation on job market. Using panel data from montly survey of employment we applied a Probit model to check the effects of the introduction of this rule on Brazilian labor market. Our results demonstrate that during the period of validity of the Convention no 158 both the probability of an individual getting a job as the probability of entering the formal labor market suffered negative effect.
