Terceirização no Brasil: avaliação do marco legal e esclarecimentos sobre o Projeto de Lei no 4.330/2004

Abstract

Atualmente, no parlamento brasileiro, há diversas propostas para instituir uma regulação legislativa da terceirização. O Projeto de Lei no 4.330/2004 é apenas uma delas – a que se encontra mais adiantada no processo legislativo. Há um debate intenso sobre se seria esta a melhor opção para regular a terceirização, uma discussão que envolve representantes de trabalhadores e empresas, entre outros. Especificamente do ponto de vista dos trabalhadores, há aspectos no referido projeto de lei que podem causar muita apreensão. Provavelmente, mais estudos deveriam ser realizados sobre os impactos da terceirização no Brasil antes de haver qualquer deliberação do parlamento sobre o tema. Afinal, a medida pode impactar fortemente a dinâmica do mercado de trabalho – em especial os trabalhadores. Nowadays, in Brazilian parliament, there are several propositions able to enact a legislative regulation to outsourcing. Bill no 4.330/04 is just one of them – probably, the one far ahead in the lawmaking process. Is this the best option for regulating outsourcing? There is a harsh debate about this, involving mainly workers’ and companies’ representatives. Specifically from workers’ point of view, there are aspects of Bill no 4.330/04 that may cause a lot of apprehension. Probably, additional studies should be made about this, before parliament’s final deliberation. After all, outsourcing may pose many relevant impacts for Brazilian labor market, especially for workers.
