Percepções sobre a Regulamentação do Lobby no Brasil: convergências e divergências

Abstract

Este trabalho procura verificar empiricamente em que medida as controvérsias sobre a regulamentação do lobby se manifestam nas opiniões dos atores políticos diretamente envolvidos na atividade no Congresso Nacional, quais sejam, representantes de grupos de interesse e assessores parlamentares de órgãos públicos. Para tanto, apresentam-se resultados de entrevistas originais, do tipo survey e em profundidade. Os resultados apontam para convergências sobre a necessidade de regulamentar a atividade e sobre as consequências positivas esperadas com a regulamentação. Convergências também podem ser verificadas quando se submete ao crivo dos respondentes boa parte das proposições legislativas apresentadas no Congresso. Contudo, divergências aparecem quando os temas mais polêmicos são abordados, especialmente aquelas propostas relativas à prestação de contas e à declaração de interesses por parte dos grupos de pressão. Conclui-se que a opinião política entre os atores que exercem a representação de interesses no âmbito do Congresso é favorável à regulamentação, mas alguns pontos devem ser levados ao debate mais aprofundado. Recomenda-se que esse debate não deve, sob nenhuma hipótese, ignorar que a atividade de lobby é um importante mecanismo de participação política e que dela depende, em grande parte, o acesso de diferentes grupos sociais ao poder constituído e seus representantes. This paper aims to empirically verify to what extent the controversies on lobbying regulation are manifested by the opinions of political actors directly involved in the activities of the National Congress, which are interest groups’ representatives and legislative advisors of governmental agencies. To this end, we present results of original survey and in-depth interviews. The results point to convergence on the need to regulate lobbying activity and about the positive effects expected to come with regulation. We also find convergence with most regulatory initiatives presented in the Congress. However, differences appear when the most controversial themes are addressed, especially those on accountability and declaration of interest on the part of pressure groups. It thus concludes that the political opinion amongst actors engaged in the representation of interests within the Congress is supportive of the regulations, but some points should be taken to further debate. It is recommended that this debate must not ignore that lobbying is an important mechanism of political participation and that it depends, largely, on the access of different social groups to the constituted power and its representatives.
