Acordo Sobre Medidas de Investimento Relacionadas ao Comércio (TRIMs): Entraves às Políticas Industriais dos Países em Desenvolvimento

Abstract

A evolução do direito comercial internacional tem diminuído o espaço para os Estados formularem políticas públicas orientadas para o desenvolvimento econômico. A perda de autonomia sobre determinadas matérias tem sido mais profunda para os países em desenvolvimento, uma vez que as disposições oriundas das negociações econômicas internacionais têm refletido, principalmente, os interesses das nações desenvolvidas. O presente texto tem por finalidade estudar uma das áreas em que a capacidade de intervenção dos países emergentes foi sensivelmente reduzida, qual seja, o Acordo sobre Medidas de Investimentos Relacionadas ao Comércio (TRIMs), forjado no âmbito da Organização Mundial do Comércio (OMC). O objetivo consiste em demonstrar que o Acordo TRIMs reduziu o espaço de manobra para os Estados em desenvolvimento adotarem políticas industriais. The evolution of the international trade law has reduced the scope for States to adopt public policies oriented to economic development. The loss of sovereignty in this field has been wider for developing countries, since the norms that regulate the international economy have expressed, mainly, the interests of the developed world. This article aims to study one of the issues in which the capacity of nations to intervene has been drastically reduced: the Trade-Related Investment Measures (TRIMs) treaty, signed under the aegis of World Trade Organization (WTO). The objective is to demonstrate that TRIMs has precluded developing nations from implementing industrial policies.
