Crise Financeira e Reformas da Supervisão e Regulação

Abstract

O exame das grandes linhas da arquitetura financeira internacional que contribuíram para o aprofundamento da crise financeira permite delinear as necessárias reformas da supervisão e da regulação. Para serem eficientes, tais reformas teriam de ser de âmbito internacional e incluir as instituições financeiras bancárias e não bancárias, cuja interação nos mercados de balcão, por meio de instrumentos como os derivativos de crédito (credit default swaps - CDS) e as securities lastreadas em crédito, teve papel significativo no processo de acumulação de riscos. A oposição dos Estados Unidos à criação de um órgão regulador supranacional levou a propostas para que essas reformas fossem discutidas nacionalmente ou no interior de blocos econômicos como a União Europeia (UE). Essas propostas são analisadas, tanto no que concerne a sua adequação ao objetivo de impedir a eclosão de novo episódio semelhante, quanto no que diz respeito aos pontos de convergência e divergência entre elas e ao estágio em que se encontram. The analysis of the main features of the international financial architecture that contributed to the deepening of the financial crisis allows to outline the necessary reforms in the supervision and regulation. To be effective, such reforms would have to be international in scope and include financial banking and non banking institutions a whose interaction in the over the counter markets, through instruments such as credit derivatives and asset backed securities had a significant role in the process of risk accumulation. The opposition of the United States has led to proposals for such reforms being discussed nationally or within economic blocs like the European Union. These proposals are analyzed, both as regards their suitability for the purpose of preventing the emergence of new similar episode, as with regard to the points of convergence and divergence between them and the stage of the development of these discussions.
