Abstract

O texto apresenta uma análise das relações entre Estado nacional e direitos humanos no Brasil entre 1968 e 1996, reconstruindo sinteticamente o processo histórico de incorporação dessa temática como política de Estado e evidenciando os condicionantes da atual configuração das políticas de direitos humanos no país. Antes de uma descrição exaustiva do período, o texto busca responder quais foram as interrelações entre a conjuntura histórica e a lógica de atuação dos principais agentes sociais e políticos relacionados à temática dos direitos humanos, tendo como marcos o Ato Institucional no 5 (AI-5), a Abertura, a Constituição de 1988 e o Programa Nacional de Direitos Humanos (PNDH). Ao fazê-lo, o texto também apresenta os atores que viriam a se tornar preponderantes para a compreensão da política nacional de direitos humanos hoje. The article presents an analysis of the relations between national state and human rights in Brazil between the years of 1968 and 1996. The purpose is to reconstruct the historical process of the incorporation of this theme as a state policy and to put into evidence the conditionings of the present configuration of human rights policies in the country. Less than an exhaustive description of the period, the text aims to answer which were the interrelations between historical conjuncture and the logics of action observed among the main social and political agents related to the human rights thematic, contextualizing the periods inaugurated by the fifth Institutional Act (AI-5) in 1968, the political opening (abertura), the 1988 Constitution and the 1996 National Human Rights Program (PNDH). By doing so, the text also presents the main actors that would become preponderant to the comprehension of the human rights national policy today. i.
