Sistema de Justiça Criminal no Brasil: Quadro Institucional e um Diagnóstico de sua Atuação

Abstract

O presente trabalho tem por objetivo investigar o sistema de justiça criminal no Brasil, integrado pelos subsistemas policial, de justiça criminal e de execução penal, sob duas perspectivas: o respeito ao Estado de Direito e a eficácia na missão de prevenir a criminalidade. A primeira parte do texto (seção 1) se dedica a apresentar o desenho institucional do sistema de justiça criminal, com os diferentes órgãos e instituições que o compõem, tanto nos Poderes Executivo e Judiciário, e o modo como se articulam nos três níveis de governo. A segunda parte (seção 2) busca examinar, a partir das informações disponíveis até o primeiro semestre de 2007, os diferentes subsistemas de justiça criminal no que concerne ao respeito ao Estado de Direito e ao alcance do objetivo de prevenir a criminalidade. Conclui-se que se tem no país um sistema de justiça criminal que constantemente viola os direitos individuais, ao tempo em que é detentor de uma capacidade de punir crimes muito aquém do número de crimes cometidos, falhando em sua atribuição de contribuir para a prevenção da criminalidade, apesar de alguns avanços alcançados nos últimos anos. The aim of this paper is to analyze the criminal justice system in Brazil - which is composed by the police, criminal justice, and penal execution subsystems - under two perspectives: the respect to the Rule of law and the effectiveness of its task of preventing crime. The first part of the text attempts to present the institutional design of the system of criminal justice, together with its different agencies and institutions in Executive and Judiciary, as well as the way it connects itself in the three levels of government. The second part examines, based on the currently available information, the different subsystems of criminal justice in relation to the Rule of law and the attainment of the objective to prevent crime. We conclude that we have a criminal justice system that constantly violates the individual rights ant that has a very low capacity to punish crimes, failing his duties to prevent crime although some progress were achieved in the last years.
