La Commission lectorale nationale ind pendante (CENI) du Burundi et la loi: les candidats poursuivis en justice sont-ils ligibles?

Abstract

Conform ment au Code lectoral en vigueur au moment de la d claration de candidature aux lections de 2010, le dossier des candidats aux lections communales, l gislatives, s natoriales et pr sidentielles devait contenir une attestation de bonne conduite, vie et moeurs. Des poursuites judiciaires en cours contre les candidats constituaient un obstacle pour obtenir une telle attestation, ce qui avait des cons quences majeures sur la recevabilit de leur candidature. Suite l entr e en vigueur du nouveau Code lectoral du 3 juin 2014, l attestation de bonne conduite, vie et moeurs ne sera plus requise des candidats aux lections pr sidentielles, l gislatives et s natoriales en 2015. L extrait du casier judiciaire ne concerne que les condamnations et ne peut pas tre refus aux candidats poursuivis en justice. Les personnes plac es en d tention pr ventive sont frapp es d incapacit lectorale temporaire, ce qui les rend in ligibles. La CENI devrait clarifier et justifier sinon corriger - la d claration de son porte-parole par rapport la recevabilit des candidatures des opposants politiques poursuivis en justice.
