劳工条款争端处理机制的近期变化趋势 基于欧美的定量和多案例比较分析

Abstract

争端处理机制是自贸协定下劳工条款的重要执行机制之一。为了促使缔约国更严格的执行承诺,欧盟和美国近年来正在对该机制不断完善。本文采用了定量数据 和典型案例比较的方法,分析总结了欧盟和美国模式下劳工条款争端处理机制的五个演进趋势,具体包括:一是专家组管辖权不断扩大,主要因为劳工条款和贸易之间的联结已经开始 被作为潜在假设,而无需投诉方证明。二是专家组不断提高做出裁决的效率。三是专家组裁决的争议类型不断增加。四是专家组做出裁决时非常倚重国际劳工组织对核心劳工权利的监 督实施机制。五是专家组裁决程序的替代性机制开始出现。上述趋势表明劳工条款的执行机制在欧盟和美国的推动下已经越来越成熟,并对缔约国遵守劳工条款产生了更强的约束力。 基于此,本文建议中国在增进对劳工条款争端处理机制最新发展趋势的基础上及时做好相关应对。.
