Du citoyen engagé au travailleur : pompier volontaire en garde postée, une activité à encadrer ? [ensosp]

Abstract

" En organisant sa réponse opérationnelle à partir d'un nombre de Centres d'Incendie et de Secours limité, le Service Départemental d'Incendie et de Secours (SDIS) du Pas-de-Calais s'appuie sur un Potentiel Opérationnel Journalier (POJ) positionné exclusivement en garde postée. Si ce mode d'organisation est bien connu et habituel pour les sapeurs-pompiers professionnels, il l'est cependant beaucoup moins pour des sapeurs-pompiers volontaires qui ne sont pas des travailleurs permanents du SDIS. La sollicitation importante des sapeurs-pompiers volontaires inquiète la direction de l'établissement qui cherche à encadrer les pratiques afin de limiter le risque d'exposition de ces derniers. Il n'est pas certain que cette démarche vertueuse soit suffisante pour dissuader le juge national ou communautaire de requalifier, à titre individuel, un SPV de travailleur. Le projet de révision de la directive européenne relative au temps de travail et sa possible application aux SPV constitue également une menace très sérieuse. Ce mémoire s'attache à explorer les voies d'évolution de nature à préserver le système actuel de sécurité civile français qui s'appuie majoritairement sur le volontariat. Entre l'idéalisation de l'engagement citoyen solidaire que représentent le volontariat et la dramatisation de la mort ou de la disparition de cette forme d'engagement, il existe peut-être des voies alternatives malgré un cadre juridique et statutaire aujourd'hui fermé. "
