"Brevets d'invention" de Charles Coquelin (1852), une critique de la propriété des inventions

Abstract

This paper, written for the project "Controversies of the nineteenth century intellectual property "[online" http://www.mshparisnord.fr/controverses-PI-XIX/ "], is a detailed analysis of the article "Patents" , written by Charles Coquelin for the Dictionary of Political Economy (1852), an analysis that allows for a brief overview of the various controversies of the nineteenth century on patents. The question divides economists at the time, lawyers, and others, some proclaiming the existence of a natural right of property of the inventor of her discoveries, a property based on the labor (Joseph Garnier, Gustave Molinari) or the right of first occupant (Ambroise-Marcellin Jobard). They call then the perpetuity of patents, by analogy with what exists in terms of land ownership. The controversy over this claim overlooks the first half of the century, while in the second half, but rather the discussion of the thesis abolitionist (Commission Granville (1852), Michel Chevalier (1863)) prevails. Charles Coquelin, for its part inclined to favor the abolition, but resigned, without much enthusiasm it is true, to accept the existing system, that is to say the principle of a limited right.
