Abstract

Toute intervention réglementaire venant faire obstacle à la liberté des prix fait courir le risque de porter préjudice au consommateur de façon directe, en le privant d'opportunités de baisse des prix, et de façon indirecte, en entravant les ajustements économiques. Cependant, le marché peut être le lieu d'abus de pouvoirs économiques liés à la mise en œuvre de capacités de coercition ou de stratégies déloyales. Il existe donc un espace pour une intervention publique visant à corriger des distorsions de marché génératrices non seulement de dommages collectifs en termes de répartition, mais également en termes d'efficacité économique à court et à long terme. L'objet de cette contribution est donc d'analyser les arbitrages possibles face à des pratiques restrictives verticales.
