Abstract

Les stratégies de compression des marges recouvrent des pratiques abusives mises en œuvre par des opérateurs dominants verticalement intégrés, visant à évincer leurs concurrents du marché ou du moins à les discipliner en érodant artificiellement leurs marges bénéficiaires. Les autorités européennes de la concurrence ont eu à traiter de nombreuses affaires de ce type, notamment dans les secteurs nouvellement ouverts à la concurrence. Les récents arrêts Deutsche Telekom (octobre 2010) et TeliaSonera (février 2011) témoignent d'une approche différente de celle de la Cour Suprême américaine. En filigrane sont posées les questions des interactions entre politiques de concurrence et régulation sectorielle ainsi que celles de la responsabilité particulière de l'opérateur dominant vis-à-vis du jeu de la concurrence.
