Abstract

To what extent might the labelling of online content as misinformation or disinformation, and the reduction of its virality, be regarded as an issue falling within the scope of competition law? A recent position taken by the Antitrust Division of the US Department of Justice, in litigation brought against news publishers and online platforms, frames such initiatives in terms of boycott practices. Under the analysis advanced by the US administration, content moderation could thus be challenged not only on the basis of the First Amendment to the Constitution, but also under the Sherman Act. This article seeks to discuss both interpretations and the instrumentalisation of competition rules in the marketplace of ideas.
