Abstract

Le décret no 9571/18, établissant les directives nationales sur les entreprises et les droits de l'homme, fut pris en novembre 2018. Dès son entrée en vigueur, l'impact négatif dudit instrument par rapport aux obligations des entreprises de garantir les droits de l'homme a été mis en évidence par les spécialistes. L'analyse du décret permet de constater son caractère précaire pour prévenir ou réparer des violations des droits de l'homme attribuables à l'activité des entreprises, ce qui est dû à l'existence de lacunes à deux niveaux : 1) des lacunes liées à la nature juridique du décret et à la portée de ses propres normes ; 2) des lacunes liées aux mécanismes d'intégration déficients. On peut considérer le décret comme un instrument insuffisant pour répondre aux attentes de la société quant à la responsabilisation des entreprises et aux garanties de respect des droits de l'homme. Il n'a que l'apparence de la législation.
