Abstract

Comme dans d'autres pays, le taux de récidive à la sortie de prison en France est très élevé : un tiers des personnes libérées ont à nouveau condamnées dans l'année suivante. Les aménagements de peine permettent ils de réduire la récidive? Les auteurs présentent plusieurs études, qui suggèrent que les aménagements de peine, tels que la libération conditionnelle et le placement sous surveillance électronique, réduisent la récidive par rapport à la détention ferme. Cependant, plusieurs études trouvent que l'utilisation de ces aménagements peut aussi entraîner une augmentation des peines prononcées, si les acteurs judiciaires ajustent leurs pratiques en conséquence. Les aménagements de peine peuvent être bénéfiques pour les personnes condamnées, mais ils doivent être appliqués avec prudence pour ne pas conduire à un allongement des peines prononcées.
