Abstract

Can the pivotal firm in a digital ecosystem be obliged to open it up to any firm that requests it, even if this access requires additional development? Can a refusal of access or a delay in granting it be regarded as a strategy of self-preferencing when it appears possible that the platform will eventually offer an equivalent service? The preliminary ruling by the Court of Justice in the Android Auto-ENEL case raises the question of the conditions for activating the theory of essential facilities in cases where access is not deemed to be indispensable for carrying out an activity on the downstream market in question, and of the obligations imposed by European competition law on gatekeepers.
