Les droits familiaux dans les systèmes de retraite : une comparaison européenne

Abstract

En matière de retraite, une grande partie de la nuance entre droits purement individuels et droits plus collectifs transite par les droits familiaux. Cet article se propose de comparer les dispositifs de droits familiaux dans les systèmes de retraite européens. Dans un premier temps sont définis le champ et les objectifs des droits familiaux. Une seconde partie s'attache à élaborer une typologie de ces droits, à décrire et à comparer les différents dispositifs dans les régimes publics obligatoires. Il ressort que ces dispositifs diffèrent selon le mode de calcul des droits à pension (en annuités, en points ou en comptes notionnels), mais que, globalement, tous les pays accordent des droits (en durée assimilée d'assurance, en points, ou en cotisations) qui compensent l'interruption d'activité que peut entraîner la parentalité sur les carrières (passage à temps partiel, interruption de carrière) et le niveau de vie familial. Plus rarement, les droits familiaux comportent des majorations de pension, incitatives à la natalité.
