L’émergence et l’Organisation mondiale du commerce. Quelles trajectoires pour le système commercial multilatéral ?

Abstract

Cette contribution a pour point de départ l'analyse de l'offre institutionnelle des pays émergents dans les négociations sur la libéralisation de l'accès aux marchés pour les produits industriels à l'OMC. L'analyse emprunte à la théorie des régimes internationaux qui distingue entre les principes et les normes (la finalité du régime) et les règles et procédures de prise de décision (les instruments du régime). Cette distinction nous permet de formuler l'hypothèse qu'entre les deux pôles de la réflexion sur l'offre institutionnelle des puissances ascendantes (puissances révisionnistes, defenseurs du statu quo), il semble possible d'envisager un changement dans le régime et non d'un changement du régime. Le régime OMC rend possible une offre institutionnelle qui, tout en consolidant les but fondamentaux et les droits et obligations constitutifs du régime, en contestent les instruments et dispositifs de régulation. Telle est la propriété centrale de l'offre institutionnelle des puissances émergentes du NAMA-11 et in extenso des BRICS à l'OMC.
