Abstract

Ce travail porte sur la transposition de la règle d'or dans l'ordre juridique français. Il propose une étude autour de quatre concepts: la validité, l'efficacité, l'effectivité et l'efficience. Il montre qu'en définitive dès le stade de l'efficacité qui suppose que la norme soit globalement respectée, la règle d'or connaît de grosses faiblesses qui ne cessent de se conformer à l'aune des deux autres concepts d'effectivité et d'efficience. LA règle d'or ne saurait en effet être interprétée comme une limitation aux droits fondamentaux constitutionnels ou européens.
