Les sanctions des réglementations des transports routiers en France et dans quelques pays européens

Abstract

Les pays européens ont des systèmes de sanction pour les infractions commises en matière de transport routier de marchandises très différents. Cet article compare, pour une quinzaine d'infractions, les dispositifs existant en Allemagne, en Espagne, aux Pays-Bas, au Royaume-Uni et en France. Les conclusions de cette comparaison peuvent être présentées en trois points : - s'agissant de la sévérité des sanctions dans les différents pays, la comparaison fait apparaître une hiérarchie assez claire par ordre de sévérité croissante : Pays-Bas, Allemagne, France, Royaume-Uni et Espagne ; - s'agissant des avantages comparés des sanctions administratives et des sanctions pénales, les premières semblent présenter un certain nombre d'avantages (sanctions plus certaines dans leur existence même et dans leur montant, plus étroitement reliées à la gravité de l'infraction, décidées plus rapidement et par des personnes qui connaissent l'activité du transport) ; - s'agissant de la réalité du marché européen des transports, même lorsque la réglementation est unifiée, les sanctions ne le sont pas, de sorte que la signification de la réglementation n'est pas la même.
