L’Optimum gouvernemental des physiocrates : despotisme légal ou despotisme légitime ?

Abstract

Cet article défend l'idée de l'existence d'une analyse originale de Lemercier de la Rivière quant au concept de despotisme légal non révélée par les commentateurs. Quesnay, chef de file des Physiocrates est habituellement reconnu pour son initiative en la matière mais la littérature mobilise systématiquement les écrits de Lemercier de la Rivière pour en faire l'exposé complet. La même ambiguïté apparaît quant à l'écriture du principal texte de Lemercier de la Rivière : L'Ordre naturel et essentiel des sociétés politiques. Cet article apporte un éclairage nouveau sur les projets physiocratiques pour fonder un état de droit. La tentative des physiocrates d'établir une forme gouvernementale spécifique (le despotisme légal) et l'idéaltype qu'ils proposent s'oppose avant tout au despotisme arbitraire. La question du despotisme constitue la matière d'un débat de fond récurrent de cette époque et les physiocrates s'en emparent pour tenter d'imposer un modèle alternatif original dans lequel les évolutions souhaitées ne sont pas conditionnées à la volonté du prince de se soumettre mais, au contraire, garanties par un cadre légal contraignant tous, monarque compris.
