Abstract

Les PSE (ou paiements pour services environnementaux) dont la définition demeure très floue, sont mis en place et promus par une myriade d'instruments très diversifiés qui « baignent » tous dans une ambiance contractuelle ou plus ou moins négociée, mais dont on peut se demander s'ils doivent tous être regardés comme de véritables contrats. L'article examine les PSE à la lumière des éléments constitutifs du contrat, avant de les analyser à la lumière des principes et des règles qui en régissent les effets.
