L'Autorité de la concurrence a utilisé pour la première fois un test UPP dans sa décision n° 12-DCC-92. Cet article présente la démarche suivie par l'Autorité de la concurrence et discute les enseignements qui peuvent en être tirés pour de futures utilisations des tests de type UPP. La décision illustre le débat sur le positionnement des tests UPP, qui peuvent être vus comme un fi ltre en phase I ou comme un indice supplémentaire venant en support de l'approche traditionnelle. Elle confi rme également les incertitudes méthodologiques concernant l'application de ces tests, qui porte notamment sur la fi abilité des données utilisées. L'article montre ainsi que cette première décision est à la fois une ouverture à l'utilisation des tests UPP et un appel à clarifi er les conditions de son utilisation.
