L'Accord de l'OMC sur les ADPIC. Impact sur la recherche-développement des médicaments contre les maladies négligées et très négligées

Abstract

Cet article vise à soumettre à l'épreuve des faits les scénarios optimistes émis par les défenseurs de l'Accord de l'OMC sur les ADPIC (Aspects des Droits de Propriété Intellectuelle qui touchent au Commerce). Il procède en quatre étapes. Dans un premier temps, il introduit le concept d'accessibilité totale et montre ses implications en termes d'analyse des problèmes d'accès aux traitements. Dans un deuxième temps, nous présenterons une typologie des maladies. L'objectif étant de fixer le cadre d'analyse et de cibler les maladies sur lesquelles vont porter nos analyses. Dans un troisième temps, nous analyserons le problème du déficit de la R-D de médicaments destinés à faire face aux besoins sanitaires spécifiques des pays en développement sous l'angle des implications de l'élévation des standards internationaux en matière de protection des brevets. Et enfin, dans un quatrième temps, nous évaluerons, à partir d'une étude de cas sur l'Inde, l'efficacité du système des brevets pour favoriser l'incitation à la recherche et à l'innovation de produits et de procédés pharmaceutiques destinés à traiter les maladies touchant principalement les pays en développement.
