Abstract

O. Blanchard, J. Tirole [2003] et P. Cahuc [2003] proposent de substituer au droit du travail une taxe sur les licenciements. Nous tentons dans cet article de mettre au jour le socle théorique implicite justifiant une telle proposition, et de discuter la pertinence d'une approche qui, en envisageant les licenciements comme source d'externalités négatives, ne permet de penser la protection de l'emploi que comme un instrument de restauration de l'optimalité paretienne. Nous présentons ensuite une modélisation alternative, construite à partir du modèle proposé par P. Cahuc, qui invalide les affirmations de l'auteur quand à l'efficacité d'une taxation des licenciements : la simple prise en compte de la suppression d'emplois rentables par certaines entreprises permet d'établir les avantages du droit sur la régulation fiscale.
