Abstract

Pour éviter que la rémunération du travail ne soit strictement soumise aux fluctuations du marché de l'emploi, la France a institué un salaire minimum légal. La première partie de cet article, d'une part, rend compte de l'évolution du salaire minimum au terme de cinquante ans d'existence, d'autre part, décrit la complexité du dispositif juridique. Cet état des lieux montre les limites d'une analyse qui se bornerait, de nos jours, à se référer au SMIC comme standard significatif de norme de vie. Dans une deuxième partie, il est démontré que le dispositif du SMIC est de plus en plus contourné par la permissivité de la puissance publique et provoque des réactions adaptatives de la part des entreprises. Les distorsions observées sont aussi bien d'ordre social qu'économique. L'intérêt du salaire minimum légal, du moins sous sa forme actuelle, est dès lors posé
