Patents, generic drugs and the markets for antiretrovirals

Abstract

In 1994, the Uruguay Round culminated by the creation of WTO which extends worldwhile patent protection for new products, including drugs. In 1996, an efficent Aids treatment was available in the world market : antiretroviral combined therapy. The coexistence of these two series of events is obviously coincidal, but has fueled intensive debates about their conflictual interaction. A focus is made on the growing tension between the dimension of the collective good of public health and profit-seeking by private firms involved in that domain. The TRIPS Agreement, part of WTO has generated new constraints to face to AIDS epidemic and other public health issues as well.Thailand and Brazil succeeded to manufacture generic drug for the benefit of domestic patients through many international obstacles. A special chapter is devoted to the prices : how are they determined ? how have the main protagosnists in this field been behaving? What can we expect in the future ?
