Abstract

Cet article présente les règles applicables à la gestion du patrimoine des mineurs en droit français. Il analyse les différents modes de représentation du mineur, notamment l'administration légale, l'administration conventionnelle, l'administrateur ad hoc, l'émancipation et la tutelle des mineurs. L'étude met en évidence la distinction entre actes d'administration, actes de disposition, actes graves et actes interdits, ainsi que les conditions d'intervention du juge des tutelles ou du conseil de famille. Elle examine également plusieurs opérations patrimoniales sensibles, telles que la vente d'un bien immobilier, l'acceptation d'une succession, l'ouverture de comptes bancaires, l'assurance-vie et la détention de parts de société civile par un mineur.
