Abstract

La copropriété occupe une place singulière dans le droit des biens contemporain. À la fois familière dans les usages sociaux et redoutablement technique dans ses constructions normatives, elle constitue un objet juridique dont l'évidence apparente masque une complexité conceptuelle profonde. Loin de se réduire à une simple modalité de la propriété immobilière, le copropriété met en jeu une articulation délicate entre droits privatifs et contraintes collectives, entre autonomie individuelle et organisation institutionnelle, révélant ainsi les mutations contemporaines du droit de propriété.
