Abstract

This document analyzes the legal and environmental tensions related to deep-sea mining (DSM) in the Pacific region. The author examines how the concept of the "Blue Economy" attempts to reconcile economic growth with ecological preservation, while highlighting the risks of pollution and biodiversity loss. The study highlights the difficulty of establishing a harmonized regulatory framework between international waters ("the Area") and zones under national sovereignty (continental shelves). It notably critiques the inadequacy of current institutional structures in the face of the ambitions of private companies and the technical limitations of small island developing states. Finally, the text calls for a rigorous application of the precautionary principle to protect this common heritage of mankind.
