Abstract

Quelles solutions pour enrayer la crise de l'eau ? Alors qu'un quart de la population mondiale n'a pas accès à l'eau potable, l'Organisation des Nations Unies organise chaque année une Conférence sur l'eau ; les négociations pour l'adoption de l'accord portant sur la conservation et l'utilisation durable de la diversité biologique marine viennent de se terminer. Alors que la bataille des mégabassines bat son plein, la France adopte un plan d'action pour « une gestion résiliente et concertée de l'eau ». Le présent ouvrage propose d'analyser l'eau – dans toutes ses formes et composantes – en tant que modèle de biens communs afin de réfléchir aux évolutions juridiques susceptibles d'améliorer l'accès, le partage, la gouvernance et la protection de cette ressource vitale. Il réunit une vingtaine de contributions qui offrent des réflexions innovantes grâce aux regards croisés entre le droit (histoire du droit, droits international, français, local, italien), la philosophie et l'anthropologie. Sabine Boussard est Professeure de droit public à l'université Paris Nanterre et directrice du CRDP. Clémentine Bories est Professeure de droit international public à l'Université Toulouse Capitole et membre de de l'IDETCOM.
