Abstract

Les distinctions entre le travail salarié et le travail indépendant issues du développement du capitalisme prennent aujourd'hui une dimension nouvelle. Entre autonomisation des salariés, capacité d'initiative individuelle, et rupture de contrat de travail facilitée, l'évolution du salariat intègre de plus en plus de flexibilité. En parallèle, l'autoentrepreneuriat se développe mais parfois sans la liberté censée l'accompagner. Tout ceci a de quoi interroger le juriste. Le cas des chauffeurs VTC a par exemple donné lieu à des décisions en apparence opposées.
