Abstract

This document provides a structured template for drafting judicial expert reports, designed to ensure compliance with key procedural requirements, in particular the adversarial principle, traceability of operations, and technical rigor in reasoning. It offers a comprehensive and operational framework for expert reporting, from the preliminary section (appointment, scope of assignment, procedural context) through to the final conclusions. The model integrates: management and adversarial communication of evidence, chronological reconstruction of facts, formalized factual findings, technical analysis based on explicit causal reasoning, systematic responses to each item of the expert's mandate, and, where applicable, the evaluation of material damages. Particular emphasis is placed on logistical traceability, especially in transport-related expertise (E.8.4), through tools such as supply chain tracking tables, identification of traceability gaps, and structured reservations. The document also incorporates requirements related to the preliminary report (synthesis note) and the handling of parties' submissions (observations / "dires"), ensuring full transparency of the expert process. Finally, practical examples (road transport, cold chain, ADR hazardous materials, cargo damage) illustrate the concrete application of the methodology, enabling immediate use by practitioners.
