Gouverner l’habitat partagé aux États-Unis

Abstract

La gestion collective de l'habitat repose partout sur un même besoin : organiser la vie en commun autour de biens partagés. Mais les réponses institutionnelles varient profondément selon les traditions juridiques et les cultures politiques. La France s'appuie sur un cadre légal unifié, centré sur la figure du syndic, conçu pour protéger les copropriétaires et sécuriser la gouvernance. Les États-Unis, à l'inverse, privilégient une logique pluraliste fondée sur les Homeowners Associations (HOA) et une multitude d'autres structures, qui relèvent davantage de « gouvernements privés » que d'un modèle administratif classique. Cet article propose une synthèse structurée du modèle américain en proposant un éclairage sur ces structures diverses, sur les implications pratiques et les enjeux de professionnalisation qui les traversent. Les références proposées peuvent notamment servir d'appui à une comparaison avec le système français.
