Abstract

Les actions collectives permettent à un grand nombre de victimes d'obtenir ensemble réparation pour un préjudice commun. La procédure est encore à l'étude en France mais elle est déjà largement pratiquée outre-Atlantique sous forme de class actions. L'ouvrage étudie les aspects économiques de ces actions : favoriser l'accès à la justice et donc l'indemnisation des victimes même les plus faibles, permettre des économies de coûts pour les justiciables et le système judiciaire, dissuader les comportements risqués, modifier le rapport de force entre consommateurs et producteurs... À l'heure du débat sur l'introduction des actions collectives en France, les atouts et inconvénients du système sont passés en revue. L'ouvrage est le fruit d'un travail de recherche réalisé par les auteurs au sein du laboratoire BETA de Nancy pour le compte du GIP Droit et Justice.
