Abstract

Le droit de la concurrence polynésien prévoit le contrôle préalable par l'Autorité polynésienne de la concurrence (APC) de tout aménagement commercial qui concerne un magasin de plus de 300 m², y compris lorsqu'il s'agit de simples changements de nom des magasins. Une mesure extrêmement rare (presque unique), qui pèse inutilement sur les coûts des entreprises et qui utilise à perte les ressources de l'Autorité, c'est-à-dire les impôts des Polynésiens. Une récente opération sans aucun enjeu vient à nouveau l'illustrer et devrait conduire les décideurs politiques à réformer le dispositif actuellement en vigueur.
