Collective strategies for protected designations of origin

Abstract

La dimension collective des stratégies juridiques est rarement évoquée alors qu'il s'agit pourtant d'une réalité ancienne, puisque les actions visant à obtenir une protection juridique de certains biens remontent, comme dans le cas du Champagne, au moins à la première moitié du XIX e siècle. De plus, celles-ci se développent dans les économies développées contemporaines, de sorte qu'en 2006, l'Union européenne comptait environ 2.500 appellations viti-vinicoles, de très loin les plus nombreuses, et, hors ce domaine, 405 AOP (dont beaucoup concernent les fromages) et 291 IGP (la plupart concernant les viandes, fruits et légumes). Et ce nombre continue à grandir régulièrement. Nous nous interrogerons d'abord sur les raisons d'être de ces appellations avant d'aborder les types de stratégies juridiques collectives mises en œuvre en matière d'appellations, pour relever, enfin, les contraintes apportées par leur dimension proprement collective.
