Harcèlement moral institutionnel à France Télécom : quand la politique dysfonctionnelle de l’entreprise devient un délit pénal

Abstract

L'arrêt historique rendu par la Cour de cassation, le 21 janvier 2025, dans l'affaire France Télécom marque un tournant majeur en droit du travail et en droit pénal. Rappelons que la direction de l'entreprise (devenue Orange en 2013) avait mis en œuvre, à compter de 2006, deux plans de restructuration qui prévoyaient le départ de 22 000 employés et la mobilité de 10 000 autres (sur quelque 120 000 employés). En 2008 et en 2009, 35 salariés s'étaient suicidés. Cet arrêt ouvre la voie à une nouvelle ère de responsabilisation des organisations, publiques comme privées, en matière de santé au travail.
