Abstract

La manière de saisir la discrimination à l'emploi par la Cour de Justice de l'Union européenne (CJUE), appréhendée non seulement comme un acte, mais aussi comme un énoncé, permet de mieux comprendre l'articulation du principe de non-discrimination avec celui d'inclusion . Le groupe concerné par l'arrêt est celui des personnes LGBTI. Toutefois, la décision a une portée universelle et s'applique également à d'autres catégories, car son but est celui de promouvoir un climat d'intégration sociale et, par ce biais, d'inclusion professionnelle en mobilisant de surcroit la doctrine des intérêts diffus.
