Abstract

En France, les « ordonnances Macron » de 2017 ont profondément changé les règles du droit du travail en simplifiant le dialogue social en entreprise. Entre autres « simplifications », elles avaient pour ambition de rendre plus incitative la mise en place d'accords d'entreprise, afin de créer du droit au plus près du travail, quitte à être plus faibles que les conventions collectives (ou accords de branche). Si cela représentait un recul du droit du travail – conquis par de longues luttes syndicales – pour la plupart des organisations, est-ce que cela ne constituerait-il pas, pour d'autres, une opportunité de créer du droit là où il n'en existait pas
