Abstract

L'histoire de l'économie sociale raconte avec constance que seules les innovations capables de produire du droit parviennent à défendre leur modèle ou tout au moins à en sauvegarder l'intégrité (Draperi, 2007). Cet exercice, les coopératives d'activités et d'emploi (CAE) ne l'ont globalement pas encore entamé. En presque quinze ans d'existence, elles se sont appliquées à développer en leur sein des pratiques, des modes d'organisation ou de management, qu'aucune norme juridique n'est venu jusqu'ici formaliser. Comment passer d'un faisceau de pratiques expérimentales à un corpus de règles positives, opposable aux tiers et mobilisable à des fins d'autorégulation ?
