Corégulation, entreprises - Agence française anticorruption. À quoi sert l’Agence française anticorruption ?

Abstract

Cette étude vise à montrer la spécificité de la corégulation État-entreprises qui existe dans la lutte préventive contre la corruption depuis la loi Sapin 2. En effet, l'Agence française anticorruption (AFA) a été créée lors des affaires Alstom et Airbus. Ainsi, l'AFA permet aux entreprises françaises de ne plus tomber directement sous le coup d'enquêtes menées par des autorités étrangères (en particulier aux États-Unis). Sur ce point, cette corégulation permet de servir l'intérêt général de lutte contre la corruption en protégeant les entreprises qui n'ont plus à transmettre automatiquement des informations stratégiques aux autorités étrangères. Toutefois, cette corégulation est multiforme, parce qu'elle comprend à la fois des obligations de mise en conformité et une coopération avec l'État, sans que le risque du procès pénal soit définitivement écarté pour les entreprises, mais aussi pour les salariés.
