Abstract

The paper challenges the ideological stance of the Senate Bill Proposal n° 419 aiming at entrenching the economic notion of commons into the French legal order, so to mitigate the purportedly mastery of private property and free enterprise. Aside from legal grounded arguments having led to the rejection of the proposal, our statement takes another approach by emphasizing the economic and ecological virtues attached to the Thomist principle of private property, that French legislators would gain to aknowledge.
